The terms and conditions set forth herein constitute the LIMITED WARRANTY provided by the Original Equipment Manufacturer, hereinafter referred to as "the OEM," for equipment purchased from S.M.A.S. Enterprises.
This Warranty is NON-TRANSFERABLE and shall apply SOLELY TO THE ORIGINAL PURCHASER who acquired the equipment directly from S.M.A.S. Enterprises.
The OEM hereby warrants that the subject equipment shall be free from functional defects in materials and workmanship for a period of TWELVE (12) MONTHS commencing from the DATE OF SUPPLY (INVOICE DATE).
Upon completion of this period, the Warranty SHALL AUTOMATICALLY EXPIRE, regardless of:
whether the subject equipment was operational or remained idle;
the duration of any prior breakdown or subsequent repair effort.
The liability of the OEM is STRICTLY LIMITED TO REPAIRING OR REPLACING the defective part(s), such determination being within the OEM’S SOLE AND ABSOLUTE DISCRETION.
Exception for Complete Replacement: The OEM RESERVES THE EXCLUSIVE RIGHT TO REPLACE THE COMPLETE EQUIPMENT should the OEM deem that satisfactory repair cannot be effectuated.
Purchaser's Rights: This Warranty SHALL NOT, UNDER ANY CIRCUMSTANCE, ENTITLE the Purchaser to: REFUND OF ANY AMOUNT or RETURN OF THE EQUIPMENT.
4.1. Warranty on Replaced Parts: Replaced parts are warranted for the REMAINDER OF THE ORIGINAL TWELVE-MONTH PERIOD OR NINETY (90) DAYS, WHICHEVER IS SHORTER.
4.2. Ownership of Replaced Parts: All components removed from the equipment and replaced pursuant to the terms of this Warranty shall become the property of the OEM.
This Warranty SHALL NOT BE APPLICABLE TO the following conditions:
5.1. Normal Deterioration and Consumables: CONSUMABLES CARRY NO WARRANTY WHATSOEVER.
5.2. Damage Due to Improper Usage or Conditions: Damage resulting from MISUSE, NEGLIGENCE, OR OPERATION INCONSISTENT WITH THE INSTRUCTIONS PROVIDED BY THE OEM.
5.3. Unauthorized Intervention: Repair or service performed by ANY PERSONNEL OTHER THAN THE OEM’S AUTHORIZED SERVICE ENGINEER.
For equipment installed outside the municipal limits of Delhi-NCR:
6.1. OEM Coverage (Technician & Freight Costs): The OEM shall bear the costs for the LODGING, BOARDING, CONVEYANCE, AND INCIDENTAL EXPENSES of its authorized service technician(s), and all PACKING AND FREIGHT charges for necessary parts.
For Warranty to remain valid:
Equipment must be reinstalled only by the OEM’S AUTHORIZED REPRESENTATIVE.
All expenses relating to shifting, transportation, and transit insurance shall be borne by the Purchaser.
The breach of any of the following conditions shall render this Warranty NULL AND VOID:
Operation of the equipment contrary to the Instructions provided by the OEM;
Installation performed by unauthorized persons;
FAILURE TO CARRY OUT REQUIRED PREVENTIVE MAINTENANCE; or
Removal, alteration, or defacement of serial numbers.
9.1. Indirect Costs Not Covered: This Warranty EXPLICITLY EXCLUDES COVERAGE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL LOSSES.
9.4. Data and Software: The OEM DISCLAIMS LIABILITY FOR ANY DATA OR SOFTWARE LOSS.
9.5. Disclaimer of Other Warranties: The OEM HEREBY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED.
10.1. Availability and Separate Terms: AMC is an OPTIONAL contract available in MULTIPLE TIERS (e.g., Standard, Lite).
10.3. Coverage Commencement: Comprehensive component failure coverage under any AMC tier commences ONLY UPON THE SUCCESSFUL EXPIRATION OF THE ORIGINAL 12-MONTH WARRANTY.
Any deviation in environmental or installation conditions may affect actual performance.
12.1. Complaint Registration: Complaint registration shall be confirmed within ONE (1) BUSINESS HOUR.
12.2. Technician Response Time Commitment:
Delhi-NCR (Premium AMC Tier): Technician shall arrive within 24 HOURS.
Delhi-NCR (No AMC/AMC Lite): Technician shall arrive within 48 HOURS.
12.3. Standby Equipment Provision (Critical Distinction):
STANDBY GUARANTEE (Premium AMC Tier): Standby equipment is CONFIRMED AND GUARANTEED if the repair duration is expected to be 24 HOURS OR MORE.
Discretionary Provision (AMC Lite & No AMC): The provision of standby equipment shall be at the OEM’S SOLE DISCRETION.
All disputes or differences arising hereunder shall be settled through binding arbitration, and jurisdiction shall vest EXCLUSIVELY WITH THE COMPETENT COURTS IN FARIDABAD.
14.1. Right to Amend: The OEM reserves the unilateral right to amend, modify, or update these Warranty Terms and Conditions AT ANY TIME.
14.3. Effective Date of Amendments: Any revised Warranty Terms shall apply ONLY TO EQUIPMENT SOLD OR SUPPLIED ON OR AFTER THE EFFECTIVE DATE OF THE REVISED DOCUMENT.
14.4. Non-Retrospectivity: NO AMENDMENT OR UPDATE SHALL RETROACTIVELY AFFECT THE WARRANTY TERMS applicable to equipment purchased and supplied prior to the amendment's effective date. The equipment shall remain governed by the specific Warranty Terms in effect on the original DATE OF SUPPLY (INVOICE DATE).
